Parking lot brawl leads to felony assault charge
Monday, February 8th, 2010Missoula police arrested a man for felony assault early Monday morning after a bloody brawl erupted during a dispute about a parking space.
Rocky Marceau, 30, was charged with felony aggravated assault and two counts of misdemeanor assault. He remains jailed at the Missoula County Detention Facility on $5,000 bail.
According to charging papers filed in Missoula County Justice Court, police arrived at 150 Grandview Way shortly after Midnight and found “three injured and bleeding men and pieces of broken beer bottle on the ground, with pools of blood.”
Marceau allegedly broke one man’s jaw and assaulted two others during the fight, which he said grew out of an ongoing dispute about a parking spot.
He told police that a friend was dropping him off after a Superbowl party and parked behind a neighbor’s car while Marceau unloaded a pot of chili and some beers.
Marceau said the neighbor became upset that his car had been “blocked in.” A few days earlier, Marceau was unloading groceries and had similarly blocked the neighbor’s car, resulting in an argument.
This time the neighbor confronted Marceau, and then slapped the chili pot and beers out of his grasp, he told police. A woman called Marceau a racist name, according to records, and then “people started fighting,” he said.
When police spoke with Marceau he had blood on his shirt, but could not explain how it had gotten there or how the victims had been hurt. An employee at the apartment complex said she heard a woman call Marceau a racist name but did not see any of the fighting.
Later on, police interviewed Marceau’s friend who had dropped him off after the Superbowl party. The friend said he watched the three men approach Marceau and start arguing with him, and then saw Marceau knock them to the ground by punching them.
The victims of the alleged assaults are a father and his two adult sons.
